The Legal Battle to Define the Law on Transnational Asymmetric Warfare
This essay describes the emerging legal battleground between states involved in transnational armed conflicts and the role of third parties – courts, international institutions, NGOs and civil society – in law development and enforcement. This legal conflict has led to the formation of two opposing “camps” within the legal and practitioner community: the “IHL camp”, which emphasizes the protection of non-combatants and the obligation to limit harm to combatants, and the “law of armed conflict camp”, which is keen to recall that the law of armed conflict serves primarily to regulate relations between fighting armies. that destroy each other. The essay highlights the fundamental gap between these two visions and examines their implications for issues such as the legality of targeted killings and the scope of judicial review of military discretion. Specific topics include the legal regime of nuclear weapons, the prohibition of chemical weapons and arms control, the development of naval warfare, asymmetric conflicts, the law of occupation and the law of cultural property. A comprehensive review of the year also describes the most important legal events and developments of 2014. An asymmetric conflict is characterized by the imbalance between the military capabilities of the warring parties (e.g. in terms of weapons technology, equipment, intelligence and troop numbers).
